Faye Griffiths*

That judgment is grounded in an international career. Faye qualified as a solicitor in England and Wales in 2008 and practised in the corporate restructuring and insolvency teams of an international firm in London. She went on to spend time in both Singapore and Hong Kong, where her experience included working as BVI counsel with a leading offshore firm, and serving as Regional Legal Counsel for a global oil and gas company, before bringing her practice to British Columbia.

 

She works closely with business owners, directors, creditors, and licensed insolvency trustees, with particular depth in the sectors that drive the BC and Sea-to-Sky economy: hospitality and craft beverage, real estate and development, and agriculture and natural resources. Her international background makes her a natural fit for matters with a cross-border dimension including foreign creditors, offshore structures, or assets held outside Canada.

When a file does need to go to court, she works alongside the firm's litigation counsel, so a client has both the negotiated path and the courtroom option under one roof.

Her commercial work covers asset purchase agreements, shareholder and partnership arrangements, supply and service contracts, and the day-to-day decisions in between.

Drawing on her own years in-house, she acts as external general counsel to business owners who want an experienced legal advisor on hand without a full-time hire. For clients she has guided through a restructuring, it is often a natural continuation of the relationship. Where a matter falls outside that scope, she brings in the firm's other lawyers or works alongside the client's other professional advisors.

Her recent representative experience includes:

• Representing an excavation company with the implementation of an informal restructuring and successful negotiation of standstill arrangements and payment holidays with its entire creditor group.

• Representing a large property developer in connection with multiple proceedings commenced by its secured creditors under the Companies’ Creditors Arrangement Act and the Bankruptcy and Insolvency Act.

• Guiding the directors and shareholders of a brewery in financial distress through challenging trading period, assessing restructuring and bankruptcy options, and contingency planning.

• Representing a group of individual investors owed substantial amounts through a failed property investment, including advising on both litigation against the company and its directors personally, and bankruptcy options.

• Advising various corporate clients on forbearance arrangements with secured creditors to ensure continued operations during periods of financial volatility.

• Representing individual debtors in connection with a highly contentious foreclosure process involving the Farm Debt Mediation Act and achieving a successful outcome for the clients.​

 

Faye lives in Whistler, BC. When she's not working with clients, you'll find her skiing, hiking, or biking in her own backyard — and generally keeping up with her young son. She knows the Sea-to-Sky business community well, and is committed to hands-on, tailored support for the people in it.
